Welcome to The Firefly Shop. These Terms of Service (“Terms”) govern your use of thefirefly.shop and purchases from The Firefly Shop LLC (“The Firefly Shop,” “I,” “me,” “we,” “us,” or “our”).

By visiting the website or purchasing a product or service, you agree to these Terms and the policies referenced below. If you do not agree, please do not use the website.

1. Eligibility

You must be at least 18 years old to place an order. A minor may use the website or receive a product only with the involvement and permission of a parent or legal guardian.

You agree to provide accurate, current, and complete billing, shipping, and contact information.

2. Products and Availability

The Firefly Shop offers curated stationery collections, gifts, accessories, and related services. Products and quantities are subject to availability and may be changed or discontinued without notice.

Every reasonable effort is made to present products accurately. Colors and appearance may vary slightly because of lighting, photography, screen settings, manufacturing variations, and the individually curated nature of certain collections.

Product descriptions, prices, promotions, and availability may be corrected or updated if an error occurs.

3. Orders and Payment

Submitting an order is an offer to purchase. An order is accepted after payment has been authorized and an order confirmation has been issued.

Orders may be declined or canceled because of suspected fraud, payment problems, pricing or inventory errors, shipping restrictions, or other reasonable business concerns. If a paid order is canceled by The Firefly Shop, the affected amount will be refunded.

Prices are shown in U.S. dollars. Applicable taxes and shipping charges are displayed during checkout.

Products are sold for personal use and gifting. They may not be purchased for commercial resale without prior written permission.

4. Cancellations, Returns, and Problems With an Order

Orders may be canceled within 15 minutes of purchase, provided fulfillment has not begun. After that period, cancellation requests cannot be guaranteed.

Except for damaged, defective, or incorrect items, all sales are final and returns and exchanges are not accepted.

5. Shipping

The Firefly Shop currently ships only within the United States. Processing and delivery estimates are not guarantees. Carrier delays, weather, holidays, incorrect addresses, and other circumstances outside our reasonable control may affect delivery.

6. Personalized Packing Videos

When purchasing a Personalized Packing Video, the customer may choose an available private-delivery or public-posting option.

Purchasing the service alone does not authorize The Firefly Shop to post the video publicly. Public posting requires the customer’s affirmative permission.

Names, addresses, gift-note contents, and other identifying information will never be shared publicly.

The Personalized Packing Video fee is nonrefundable, including when the related order is later canceled or returned, except where required by law or when The Firefly Shop cannot provide the purchased service.

7. Gift Notes

Customers are responsible for the content they submit for handwritten gift notes.

The Firefly Shop may refuse or request changes to a message that is unlawful, threatening, discriminatory, obscene, harassing, defamatory, or infringes another person’s rights. If The Firefly Shop declines to provide a gift note and no acceptable revision is agreed upon, any charge specifically paid for that unused gift-note service will be refunded.

8. Children’s Products

Some products may be appropriate for children when used with suitable adult guidance. Customers should review and follow all product-specific age recommendations, safety instructions, and manufacturer warnings.

Products containing small accessories are not appropriate for children below the age stated on the applicable product page or packaging. Adult supervision may be recommended depending on the product.

9. Intellectual Property

The website’s original text, photographs, graphics, branding, collection names, videos, and other content belong to The Firefly Shop LLC or are used with permission. They may not be copied, reproduced, republished, sold, or used commercially without prior written permission.

You may access the website and its content for personal, noncommercial shopping purposes.

10. Acceptable Use

You may not use the website:

For an unlawful, fraudulent, or harmful purpose;
To interfere with the website’s operation or security;
To introduce malicious code;
To collect information about others without authorization;
To impersonate another person;
To infringe intellectual-property, privacy, or other legal rights; or
To place false, abusive, or unauthorized orders.

Access may be limited or terminated when these Terms are violated.

11. Third-Party Services

The website is hosted by Shopify and may use payment processors, shipping carriers, analytics services, social-media platforms, and other third-party services.

Those services may have their own terms and privacy practices. The Firefly Shop is not responsible for third-party websites or services outside its reasonable control.

12. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. The Firefly Shop does not guarantee that the website will always be uninterrupted, secure, or free from errors.

To the fullest extent permitted by law, The Firefly Shop LLC will not be liable for indirect, incidental, special, or consequential losses resulting from use of the website or products.

Nothing in these Terms excludes a warranty, remedy, liability, or consumer right that cannot legally be excluded or limited. Nothing limits liability for fraud, willful misconduct, gross negligence, or personal injury where such a limitation is prohibited by law.

13. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

Before filing a legal claim, you and The Firefly Shop agree to make a good-faith effort to resolve the concern by contacting one another. If a dispute cannot be resolved informally, it may be brought in an appropriate state or federal court serving Loudoun County, Virginia, unless applicable consumer law requires otherwise.

This section does not prevent either party from pursuing an eligible matter in small-claims court.

14. Changes to These Terms

These Terms may be updated when the shop, its services, or applicable requirements change. The updated version will be posted on this page with a revised “Last updated” date.

Changes apply prospectively from the stated effective date. They do not retroactively change the terms governing an order already accepted unless required by law.
